Holden man David Mackenzie is facing serious charges after allegedly hitting an 87-year-old pedestrian while driving drunk in Brewer. Mackenzie, who drank 12 beers at a bar before the incident, is charged with four felonies including aggravated operating under the influence and leaving the scene of the accident.
The trial lasted three days with the jury hearing from numerous witnesses. The prosecutor argued that Mackenzie was impaired due to consuming 12 beers, while the defense pointed out that the beer was light and Mackenzie had also eaten food. The defense also argued that Mackenzie did not intentionally hit the pedestrian and did not appear impaired in video footage.
The crash happened in an area with poor lighting, making it difficult for Mackenzie to see the pedestrian. After the crash, Mackenzie stopped for a short period before driving away, leading to questions about whether he knew he hit someone. The jury must now determine whether Mackenzie is guilty of the charges beyond a reasonable doubt.
