Judge halts implementation of Maine’s 72-hour waiting period for gun sales

PORTLAND, ME – A federal judge in Portland has granted a request from gun rights groups to temporarily pause a new three-day waiting period on firearm purchases. Chief U.S. District Judge Lance Walker ruled in favor of the plaintiffs, arguing that the waiting period, enacted earlier this year, is unconstitutional. The law was implemented following the mass shooting in Lewiston in 2023.

Walker’s decision stated that acquiring a firearm is essential for exercising the right to bear arms. The waiting period was intended to address Maine’s high suicide rate involving firearms by allowing for a cooling-off period. Gun rights groups countered that the waiting period is unconstitutional and harms local firearm dealers. Gun safety advocates criticized the ruling, noting that waiting periods have been upheld in other states and can save lives.

Attorney General Aaron Frey expressed disappointment with the ruling and plans to defend the law, which he believes has public safety benefits. The state is expected to appeal the decision, which has been celebrated by Gun Owners of Maine as a victory for responsible gun owners.

Walker’s ruling did not consider legislative intent or evidence of the waiting period’s effectiveness. He criticized the waiting period as overly broad and not in line with historical firearm regulation standards. The ruling has sparked controversy among advocates and gun rights groups, with both sides preparing for further legal action.

The judge’s decision to grant a temporary pause on the waiting period highlights the ongoing debate surrounding gun control measures in Maine and the nation. For now, the law remains in limbo as both sides await further legal proceedings.
