Maine Attorney General Requests Judge to Reinstate 72-Hour Waiting Period for Gun Sales

Maine Attorney General Appeals Decision to Pause Gun Sales Waiting Period

Maine Attorney General Aaron Frey is appealing a recent decision by Chief U.S. District Judge Lance Walker to suspend a new waiting period for gun sales. The law, which took effect in August, requires a three-day waiting period for buying firearms. Gun rights groups, including a self-defense teacher for victims of domestic violence and a state representative who sells guns, sued Frey over the law in November.

Judge Walker granted the plaintiffs’ request to halt the waiting period, stating that they face irreparable harm if the law is overturned and that it interferes with their second amendment right to bear arms. Frey’s office has appealed Walker’s decision to the 1st U.S. Circuit Court of Appeals, asking for the waiting period to be reinstated while the case is being considered.

Assistant Attorney General Christopher Taub argued that waiting periods save lives by reducing both suicides and homicides. He also pointed out that similar laws in other states have been upheld by courts. The 1st Circuit is also considering an appeal from Vermont, where a federal judge ruled against gun rights groups challenging a waiting period law.

The outcome of this appeal could have significant implications for gun sales and regulations in Maine and other states. This story will be updated as it develops.
