Legislative Bill Aims to Protect Personal Belongings of Homeless Individuals in Maine
In September 2023, city employees in Portland cleared a homeless encampment beneath the Fore River Parkway Trail, spotlighting the ongoing issue of homelessness in Maine. The situation came to the fore when Katie Spencer White, president and CEO of Mid-Maine Homeless Shelter & Services, shared a poignant interaction with a woman panhandling outside Trader Joe’s. The woman opted to use the cash for her storage unit containing cherished personal items rather than for a hotel room, emphasizing the significance of her belongings amid homelessness.
In response to similar concerns, advocates, including Spencer White, testified in support of Bill LD 1410 during a recent legislative hearing. This proposed law aims to ensure that personal items of homeless individuals are not confiscated or destroyed without proper notice. Proponents argue that preserving belongings is crucial for mental well-being and dignity, especially when many have lost vital possessions during city-led cleanups.
However, the bill faces opposition from the Maine Department of Transportation and the Maine State Police, citing logistical challenges with storage and tracking. They argue that the requirement for advance notice and hearings would create burdensome processes for municipalities.
Sponsored by D-Bangor Rep. Ambureen Rana, LD 1410 seeks to establish "basic due process" by mandating at least seven days’ notice before the removal of any belongings, along with a hearing to address the situation. If individuals cannot attend, their belongings must be stored for at least 90 days.
Former Portland City Councilor Anna Trevorrow highlighted the bill’s potential to offer clarity on safeguarding the rights of vulnerable citizens. Nonetheless, state agencies stress that the requirement could add significant administrative challenges and costs. As Maine grapples with rising homelessness, LD 1410 represents a critical step toward protecting the dignity and rights of those affected.
