AUGUSTA – The Maine Legislature’s Judiciary Committee faced a partisan divide during a recent work session focused on bills regarding transgender athletes. The committee discussed eight proposals aimed at regulating the participation of transgender girls in girls’ sports teams and their access to facilities aligned with their gender identity.

The session came after a public hearing that drew significant attention. Most Democrats opposed the bills while Republicans generally supported them. Notably, Rep. Dani O’Halloran (D-Brewer) broke ranks, expressing concern for the impact on all girls involved in sports. “We have not only transgender girls but also transgender boys in girls’ sports, which complicates matters,” she remarked.

The voting resulted in a 6-6 tie on two critical bills, with Rep. Adam Lee (D-Auburn) abstaining due to a conflict of interest involving his law firm. In contrasting positions, Rep. Amy Kuhn (D-Falmouth) criticized the bills as harmful to vulnerable students and the broader school community.

One bill introduced by Rep. Liz Caruso (R-Caratunk) proposed the establishment of male, female, and coed teams. Opponents raised concerns regarding the financial feasibility of maintaining coed teams and the challenges of verifying gender identity.

Rep. Rachel Henderson (R-Rumford) sought to clarify her stance, emphasizing that her support for the bills was not driven by animosity towards the LGBTQ community.

Maine’s policy on transgender athletes gained national attention following a public dispute between President Donald Trump and Governor Janet Mills, highlighting the tension surrounding federal guidelines versus state autonomy.

As the Judiciary Committee concluded its discussions, Rep. Dylan Pugh (D-Portland) remarked on the need for unity amid divisive national narratives, emphasizing the good faith of all committee members. The proposed legislation will advance to the full Legislature for further consideration.
